  1. Introductory Clause

    Welcome to Earth United App. By downloading, installing, or using the Earth United App ("App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to this EULA, do not use the App.

  2. Permitted Use

    The App is licensed, not sold, to you by Earth United Ventures B.V. for use strictly in accordance with the terms of this EULA. You are granted a non-exclusive, non- transferable, revocable license to use the App for personal, non-commercial purposes strictly in accordance with this EULA.

  3. Restricted Use

    You agree not to, and you will not permit others to:

    1. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App or make the App available to any third party.
    2. Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App.
    3. Use the App for any unlawful purpose or in a way that violates any applicable law or regulation.

  4. Termination Conditions

    This EULA is effective from the date you first use the App and shall continue until terminated. Your rights under this EULA will terminate automatically or otherwise cease to be effective without notice from Earth United Ventures B.V. if you fail to comply with any terms of this EULA. Upon termination of this EULA, you shall cease all use of the App and uninstall all copies of the App.

  5. Warranties & Disclaimers

    The App is provided on an "AS IS" and "AS AVAILABLE" basis with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, Earth United Ventures B.V. disclaims all warranties, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.

  6. Limitation of Liability

    To the fullest extent permitted by applicable law, in no event shall Earth United Ventures B.V. be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

    1. Your access to or use of or inability to access or use the App;
    2. Any unauthorized access to or use of our servers and/or any personal information stored therein;
    3. Any interruption or cessation of transmission to or from the App;
    4. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party;
    5. Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

  7. Jurisdiction and Governing Laws

    This EULA shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Amsterdam, The Netherlands, for the resolution of any disputes arising from or relating to this EULA or your use of the App.

    This EULA incorporates by reference Earth United's Privacy Policy and any other policies or documents that are available within the App or on our website, which may be updated from time to time.

  10. Copyright & Intellectual Property

    All content, features, and functionality of the App (including but not limited to text, graphics, logos, images, and software) are the exclusive property of Earth United Ventures B.V. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
