Introduction/Overview
Welcome to the Earth United Platform. By accessing or using the Earth United Platform ("Platform"), including downloading the Earth United app from the Apple App Store or Google Play Store, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use the Platform.

Licensing
Earth United Ventures B.V. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes, subject to these Terms. This license is granted on the condition that you comply with these Terms.

Refunds and Returns
Earth United offers free and paid memberships. As the Platform offers digital content and services, all sales of paid memberships and any other digital content or services are final. Refunds are not available, except as required by applicable law.

Warranty/Disclaimer of Warranty
The Platform, including all content and services, is provided on an "AS IS" and "AS AVAILABLE" basis. Earth United Ventures B.V. makes no warranties, express or implied, regarding the Platform, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of the Platform is at your sole risk.
Earth United shall comply with all EU Data Protection Laws and take appropriate technical and organisational measures to protect its equipment, infrastructure and connection against viruses, malware and similar threats. Earth United shall ensure that third parties shall not have access to the Member’s Personal Data other than third parties necessary to provide access to the Platform with whom Earth United has an effective (sub)processing agreement or other services agreement the with terms that adhere to the same or higher level of confidentiality and data protection regarding the Member’s Personal Data as is safeguarded in this Agreement. Earth United shall be primarily and solely responsible for any violation of a third party of the confidentiality and data protection terms under this Agreement.

Delivery
Upon successful registration and, if applicable, payment of the subscription fee, digital content and services will be accessible immediately. No physical delivery is required or applicable for digital content and services provided via the Platform.

Quality of Display
Earth United Ventures B.V. does not guarantee the quality of display of content on the Platform, which may vary depending on your device, internet connection, and other technical factors.

Membership
– Free Membership: Free users can access limited content and request products and services within the Network app.
– Paid Membership: Paid members can post products, services, stories, and events within the Network app, and access additional content under the Learn Portal. All members must adhere to Code of Conduct explained in clause 9. Failure to comply with the code of conduct may result in suspension or termination of membership.

Removal of Digital Content
Earth United Ventures B.V. reserves the right to remove or restrict access to any content that violates these Terms or Code of Conduct, or is otherwise deemed inappropriate, harmful, or unlawful.

Copyright
All content on the Platform, including text, graphics, logos, images, and software, is the exclusive property of Earth United Ventures B.V. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Unauthorized use of any content is strictly prohibited.

Code of Conduct
All users must:
– Respect others and avoid harassment, bullying, hate speech, and offensive behavior.
– Not post or share any content that is disinformation, misinformation, illegal, harmful, false online engagement (e.g., comments, reviews) or violates the rights of others.
– Not engage in, post or promote activities that harm the environment or go against the principles of sustainability.
– Not Impersonating another individual or organization without consent or legal right.
– Not use the platform for commercial solicitation or spamming.
– Use the Platform in a lawful manner. Earth United Ventures B.V. reserves the right to take appropriate action, including suspension or termination of membership, against any user who violates the code of conduct.
– Respect copyright and intellectual property rights. Only share content you own or have the right to use and distribute.
– Credit original creators and follow fair use guidelines when sharing third-party content.
– Integrity in Transactions: Ensure all your listings in the network platform are accurate, legal, and ethical. Misleading descriptions, fraudulent activities, and the posting of prohibited items are strictly forbidden.
– Sustainability First: Products and services offered in the network platform should align with sustainability principles. Avoid listing items that cause environmental harm or contradict our sustainability ethos.
– take all reasonable measures to prevent personal Login Codes from becoming known to unauthorised persons and that the member shall immediately notify Earth United if it discovers any form of unauthorised use of personal Login Codes, any other breach of the security measures with regard to the Software/app that provides access to the Platform.
– shall not cause any damage to or risk for Earth United’s reputation, provided that the member shall be entitled to make truthful statements about the Services, the Software/Platform and the provision of customer service in connection with the Services and the Software/Platform.
– shall not decompile, disassemble, reconstruct, reverse engineer or otherwise attempt to recreate or design any intellectual property, component or software.

Reporting and Enforcement in the Network Platform and Content Sharing
– Reporting Mechanisms: Users are encouraged to report any violations of these conditions, especially in the marketplace and content sharing sections. Use the platform's reporting tools or contact our support team directly.
– Review and Action: The Earth United team will review reported incidents promptly. Actions may include removing content, suspending accounts, or other measures necessary to maintain the integrity of the platform.
– Earth United reserves the right to remove any content that violates these conditions, suspend or terminate accounts, and take appropriate legal action against violators.

Revisions to the Code
– Earth United may revise this Code at any time. Users will be notified of significant changes and are expected to review and comply with the updated Code.
